SOUTHWINDS HOMEOWNERS ASSOCIATION ARCHITECTURAL GUIDELINES
PURSUANT TO: BY-LAWS OF SOUTHWINDS HOMEOWNERS ASSOCIATION ARTICLE IX – COMMITTEES
The purpose of the design Review policy is to keep the community attractive for the enjoyment of residents and for the protection of property values. Properly exercised, design review can create and preserve an attractive, livable community. Failure to exercise design review properly can create major problems among the homeowners, inconsistencies and unfairness in treatment in excess of real or imagined violations, and a series of expensive and protracted court cases. Additionally, the association and its members may suffer major property value losses if design review is absent or ineffective. A properly designed and operated system of design will yield substantial benefits to all. An essential element of successful design review is a recognition by all members of the community that it is a benefit, not a burden.
As stated in the Covenants and Restrictions Article VI: No building, fence, wall or other structure shall be commenced, erected or maintained upon the properties, nor shall any exterior addition to or change of alteration therein be made until the plans and specification showing the nature, kind, shape, height, materials, and location in relation to surrounding structures and topography to be reviewed and approved by the Board of Directors of the Association, or by an architectural committee composed of three (3) or more representatives appointed by the Board.
This approval will be carried out in the following manner. Both sets of building and alteration plans to be presented to the City of Port Orange Building Official for review and endorsement in writing by stamp with “REVIEWED FOR CODE COMPLIANCE” shall first be reviewed and endorsed by the Chairperson of the Architectural Review Committee of his/her duly authorized representative in writing on said plans, with “Reviewed for Southwinds Homeowners Association Architectural Guidelines Compliance” and signed by the Chairperson or his/her duly authorized representative. One set of the signed plans shall be kept on the worksite, as required by the Building Officials and shall be made available for review by the Chairperson or his/her duly authorized representative upon request.
EXTERIOR MINIMUMS:
- The front (*), sides (*), and rear (*) of the units will be of natural stone, natural brick, natural solid wood siding, reverse board and batten siding (solid plywood), or stucco (combination of materials is permitted (**).(**) Veneer on composite, fiberboard, particle board, Masonite or aluminum type siding is not permitted on any portion of the exterior.
- (***) Actual wall space does not include windows, doors, screened areas, shingled roofs, chimneys, gables or posts.
- (*) A minimum of 30% of the front walls; and front and side walls for a corner lot (***) excluding gable frame areas, must be covered with natural stone, natural brick, or natural solid wood siding.
MATERIALS AND THEIR LIMITATIONS
- Aluminum Windows and Doors. Bronze, Black or White only;
- Exterior siding must be wood. Veneer on composite, fiberboard, particle board, masonite or aluminum is not acceptable;
- Fence – Wood or Vinyl only. Height – four (4) feet to six (6) feet. All requests handled individually. Units around lakes/ponds will be approved for four (4) foot high fence only. Location must be 4” inside property line. Finished side of fence must face out to adjacent properties. Fence cannot extend forward beyond back of building line of house. Finish must be similar to finish of house or natural stain. Vinyl fence must be a neutral color such as tan or white. No unfinished fences will be accepted. (Natural state allowed to weather);
- Fascia and Soffit. Aluminum or wood fascia. All soffits, entrance porch ceilings, and screened porch ceilings must be closed in unless “open beam” design is utilized;
- Shingles. Minimum weight 235. Color to be approved on an individual basis;
- Garage Doors. No fiberglass, aluminum or plastic doors. Solid wood or steel only. Lites (windows) allowed;
- Main Front Door. Solid wood or steel; lites (windows) allowed;
- Concrete. Sidewalks, driveways, and patios only. Sidewalk must extend from front door to driveway. All driveways must be able to accommodate two (2) cars, side by side (16 ft minimum width at parking apron abutting overhead garage door);
- Sod. Lots must be sodded, including all areas adjacent from paved streets to front and side of lot. On corner lots, the areas adjacent to the lot on both sided must be sodded to the street. All lots will be sodded with St. Augustine grass (New construction & replacement for full lot only);
- Trees. Trees which are at least six (6) inches in diameter, on individual lots, must have approval by the Architectural Review Committee before removal and/or application to the city of Port Orange, for a tree removal permit. Under no circumstances will any tree of any size be removed from any common area without prior approval of the Architectural Review Committee of the Homeowners Association Board of Directors;
- Colors. Natural Earth Tones. No bright pastels colors acceptable. Colors must be approved by the Architectural Review Committee;
- Driveway Lights. All units must have at least one (1) light, or equivalent, adjacent to the driveway;
- Porches. Construction must be of wood, brick, or stone. Brackets for screening can be aluminum (white, black, or bronze);
- Concrete Block. Must be covered with stucco, natural brick, natural stone, board lumber or natural wood siding (*);
- (*) Natural wood siding is wood siding with real wood on the surface. (RB&B) no seams showing and properly flashed. No simulated products are to be used for outside surface (as in stucco brick);
- Brick. Natural brick only;
- Stone. Natural stone only;
COMMON GROUNDS
No encroachment into the common grounds is allowed unless so addressed in Exhibit “C” of the Southwinds P.U.D. Agreement. This includes, but is not limited to, the construction of building or any structure in these areas.
No dumping of construction materials or other debris on common ground is allowed.
Common grounds may be enhanced for the following reasons but must have prior approval by the Architectural Review Committee:
- Clearing of brush
- Removal of dead trees or tree limbs
- Clearing of debris
On the event said Board, or its designated committee, fails to approve or disapprove such design and location within thirty (30) days after said plans and specifications have been submitted to it, approval will not be required and this article will be deemed to have been fully complied with.
